That's a distinction without a difference, because she apparently still had time to transmit (10 years including 5 after age 14) and of course it's all academic because the 14th amendment was in effect.

Citizenship is generally determined by the law of the claiming country, but jurisdiction is usually the more important issue.

I still have a hard time understanding what the fuck the question is. Look at the facts.

Fact: President Obama was born in Hawaii, the state has verified the birth certificate and there is a birth notice in the Honolulu newspaper records stating the Hospital he was born in.

Fact: Obama had to provide proof he was eligible to run for the office when he filed to run.

Fact: President Obama has provided his birth certificate on his website during the campaign and the REPUBLICAN governor of Hawaii verified the fucking Birth Certificate.

And before some one claims a Certificate of Live Birth is not the same thing, that is exactly what I have and I was born in Arizona!

I have passed along this personal story more times than I like to count, I'll do so ONE MORE TIME, in July 2007 my NJ drivers license expired, and in order to renew it I had to produce my "birth certificate".  Now I went in to DMV with my original hospital issued certificate complete with mom & dad's thumbprints and my itty bitty teeny weeny footie prints.  I was informed this was no longer a "valid" legal document, even though it got my ass into the US Air Force in Dec 1976.  So I went with out driving for a few months.

Along came the new year (2008) and I decided to go over to the "state building" at Broad & Spring Garden streets, in Philadelphia, and apply for my "official" state issued birth certificate.  I filled out the paper work fully expecting to pay the 18 dollars for an expedited application.  I lucked out when the woman that was waiting on me & my wife heard that I had been military.  I ended up getting it done for FREE, and got it in the mail two days later, so now armed with the "valid" legal document I was able to renew my NJ Drivers license.

The Certificate I got as tazzy pointed out earlier looks very similar to what is posted on Factcheck.org, for President Obama.  Also it has an issue date of Jan 2008, which is approximately 49 years 11 months AFTER my BIRTH.  SO to all you fucking birth-tards, please please keep this stupidity up, it most definitely will cost you dopes the 2012 presidential election.  Oh and what are you morons gonna do when all the state laws, that are being proposed for proof of eligibility, are thrown out as UNCONSTITUTIONAL?  Going to resort to your "second amendment remedies"??  Sure go for it, and when the US military is called upon to put down your little armed insurrection please ignore the laughter from me as you get your ass shot off.  I most eagerly await the use of artillery (specifically 105mm) on an insurrection, the smell of pants being soiled should provide a few laughs as well.

It was just that rml's post had me thinking of some huge vault full of filed afterbirth. A government depository of that, not just somebody who has something their parents saved in a jar next to the papers from the day they were born...

That's not even uninformed speculation.
SCOTUS does not issue statements re granting/not granting cert.
Every case brought to SCOTUS has been a direct appeal of denial of standing.
No Court has heard, seen, touched, smelled, felt, or admitted the first piece of evidence.
There is no way of knowing whether or not there is a question.
We know only that SCOTUS has not granted cert to the appeals of those denied standing.
