First of all, they are investigating (there are some limited federal statutes) but that is a long way from proceeding with a case. They could equally say, we can find no cause to prosecute.

Secondly, what I am pointing out is that people can be acquitted under one statute and convicted under another, and not double jeopardy. Something they obviously don't have you teach in your shithouse law classes, where you are instructing prosecutors to phone it in, under the law.
