The Trump Collusion Case Is Not Getting the Clinton Emails Treatment

If the Justice Department is hell-bent on making a case, it plays an intimidating game of hardball.



In July 2016, the Obama administration announced its decision not to prosecute Hillary Clinton for felony mishandling of classified information and destruction of government files. In the aftermath, I observed that there is a very aggressive way that the Justice Department and the FBI go about their business when they are trying to make a case — one profoundly different from the way they went about the Clinton emails investigation. There, they tried not to make the case.

That observation bears repeating today, as we watch Special Counsel Robert Mueller’s investigation of any possible Trump-campaign collusion in Russia’s alleged interference in the 2016 presidential campaign. Mueller is a former FBI director and top Justice Department prosecutor. To say he is going about the collusion caper aggressively would be an understatement. The earth is being scorched by the stunningly large team he has assembled, which includes 16 other prosecutors (among them, Democratic party donors and activists) along with dozens of investigators (mostly from the FBI and IRS).

At the end of October, Mueller announced the first charges in the case. In the intensive commentary that followed, another investigative development attracted almost no attention. But in terms of Mueller’s seriousness of purpose, it speaks just as loudly as the George Papadopoulos guilty plea and the indictment of Paul Manafort and Richard Gates.

Mueller succeeded in convincing a federal judge to force an attorney for Manafort and Gates to provide grand-jury testimony against them. As Politico’s Josh Gerstein reports, just as the charges against these defendants were announced with great fanfare, the U.S. district court in Washington, D.C., quietly unsealed a ruling compelling the testimony of the lawyer — who, though not referred to by name in the decision, has been identified by CNN as Melissa Laurenza, a partner at the Akin Gump law firm.

Interestingly, the jurist who rendered the 37-page memorandum opinion is Beryl A. Howell, who served for years as a senior Judiciary Committee adviser to the fiercely partisan Democratic Senator Pat Leahy (of Vermont) before being appointed to the bench by President Obama. Howell is now the district court’s chief judge. Why do I think that, in choosing to set up shop in Washington, Mueller and his team noted the district court’s local rule that vests the chief judge with responsibility to “hear and determine all matters relating to proceedings before the grand jury”? (See here, Rule 57.14 at p. 168.)

And why do I think that the Trump collusion case is not getting the kid-glove Clinton emails treatment?

Lest we forget, President Obama had endorsed Mrs. Clinton, his former secretary of state and his party’s nominee, to be president. Moreover, Obama had knowingly participated in the conduct for which Clinton was under investigation — using a pseudonym in communicating with her about classified government business over an unsecure private communication system.

Obama prejudiced the emails investigation. Long before it was formally ended, he publicly pronounced Clinton innocent...

I typically do not watch Hannity, but last night I caught a few minutes of his talking with a reporter who seems to more or less know whats going on with the informant concerning Hillary. Hannity was pressing her as to whether or not she could characterize his future testimony as "devastating" and she said yes.

also, tucker Carlson was interviewing a reporter who talking about how the fbi hasn't been forthcoming with all the material they have in relation to the fake dossier, and how it was used by law enforcement after the fact.

Top Republican who led Benghazi panel used $150,000 of taxpayer money to settle claim with a fired staffer
In 2016, Republican Rep. Trey Gowdy of South Carolina reportedly used $150,000 in taxpayer money to settle a veteran-discrimination and retaliation claim with a former aide.
The ex-staffer, an officer in the Air Force Reserves, alleged that Gowdy had discriminated against him after he took leave for his service-related obligations.
At one point, the aide also alleged that Gowdy's high-profile investigation into the 2012 Benghazi attack was taking a partisan turn and focusing on then-Secretary of State Hillary Clinton.

Republican Rep. Trey Gowdy of South Carolina reportedly settled a veteran discrimination and retaliation claim from a former aide for $150,000 in taxpayer funds, according to a Washington Post report published Friday.

The confidential settlement was identified in an Office of Compliance report released on Friday. The Post said it was able to link a mention about the settlements contained in the documents to the claims made by Bradley Podliska, the former staffer, identified by The Post.

Podliska, who was fired in 2015 from the House Benghazi committee investigating the 2012 attacks in Benghazi, Libya, alleged that he was wrongfully terminated in part for his unwillingness to engage in what he believed was a partisan investigation into Hillary Clinton's time as US secretary of state. Podliska alleged that the high-profile investigation focused its attention on Clinton and the State Department after discovering she had used a private email server to conduct government business.

As part of his veteran-discrimination claim, Podliska, an Air Force Reserves officer, alleged that he was discriminated against when he took leave for his service-related obligations.

In October 2015, Gowdy claimed that Podliska was fired for mishandling classified information. Podliska alleged that Gowdy had defamed him and harmed his career prospects, according to the Associated Press. The case was eventually settled in 2016, and the terms of the settlement were reportedly secret at the time.

Peter Romer-Friedman, Podliska's attorney, declined to discuss details of the settlement when contacted by The Post, but he noted that he was unaware of any similar cases that had been settled within the last five years.

Senator: Comey’s remarks on Clinton probe heavily edited

WASHINGTON (AP) — A draft statement former FBI Director James Comey prepared in anticipation of concluding the Hillary Clinton email case without criminal charges was heavily edited to change the “tone and substance” of the remarks, a Republican senator said Thursday.

Some of the edits proposed to the May 2016 draft, obtained by The Associated Press, appear to soften the gravity of the bureau’s findings.

Comey, for instance, initially wrote that the FBI believed that Clinton and her aides were “grossly negligent” in their handling of classified information, language also contained in the relevant criminal statute.

But the text was edited to say that the former secretary of state and her aides were simply “extremely careless” in their use of a personal email server, a phrase Comey adopted for his July 5 public announcement that the FBI would not be recommending charges.

In addition, while Comey initially said it was “reasonably likely” that “hostile actors” had gained access to Clinton’s email server, the text was edited to say that such an intrusion was “possible.”

Though the FBI had not yet interviewed Clinton, then the Democratic candidate for president, at the time the statement was drafted, FBI officials had already determined that criminal charges were probably not warranted and had begun thinking about how to present that conclusion to the public.
