Not in the US maybe. Not sure about here in the UK. We have The Race Relations Act here . Its too long and stuffy probably to go and read it. But some peeps have been prosecuted under it. And not for saying much either, depending on which papers you read.

Interesting. Well here our rights to free speech even cover racist people who want to be straight up jackasses. I don't agree with what they say, but they have the right to do it. Fortunately the power of the dollar keeps most public figures in check much better than the law ever could.

I'd suspect that most of the stories in the Mail and Torygraph are about as substantial as the various looney left claims they're into.
I don't remember either complaining about it being used to prosecute the twat who was demonstrating against the trial of the cretins who blew up the London Underground, though. Funny that. The silence in the red tops about that was almost deafening.

can a joke can be made about a racial stereotype devoid of any mal intent and actually be funny,

Interesting points. I think some “racist jokes” are simply funny. Perhaps we should grade these jokes from category one to category X, according to intent.

Here is a category 1 racist joke:

Q/ Why do black men wear baggy trousers?
A/ Because they’re [their] negroes [knee grows]

I remember that one from my school days. Notice that to be funny it relies entirely upon a pun, and nothing more. It is simply a play on words. This is surely not offensive to black people.

As we ascend the scale, we see aspersions that consider a,b and c, where x,y and z are increasingly offensive

For me then, a real “racist”joke is one intended to cause offence. The greater the offence intended, the less funny, and more harmful it becomes

I can't speak for all black people but I personally find it offensive. I would defend to the death your right to say it, but if you were a comedian I would not pay to see you and if you were someone I knew personally I would simply stay away from you.

In the UK you may not inflame racial hatred I think. Might be wrong. As you can imagine a horse and coach could be driven through that one.

Also, I think it matters, who and what you are, and whether the state wishes to take action against someone for its own purpose. For example Nick Griffin the leader of the BNP has been prosecuted under the Race act. I still want to know what he actually said. It might be serious, or it might be for the kind of thing we all hear in bars and clubs.

It does impinge upon our right to free speech. That is what concerns me. It is also probably just the thin end of the wedge. It does seem that the uk is increasingly becoming a police state. We may not have referendums on issues we have expressed interest in. We may not have guns. We may not speak as we please. And the list is greater still.

Some maybe. But a lot? I have doubts. And certainly the scales are waaaayyyy out of balance in modern times (defined by me as say from the dawn of Liberalism and Rationalism) Or hey, narrow it down to 1776 - 2010. You can begin with the history of lynchings in this country.

From 1882-1968, 4,743 lynchings occurred in the United States. Of these people that were lynched 3,446 were black. The blacks lynched accounted for 72.7% of the people lynched. These numbers seem large, but it is known that not all of the lynchings were ever recorded. Out of the 4,743 people lynched only 1,297 white people were lynched. That is only 27.3%. Many of the whites lynched were lynched for helping the black or being anti lynching and even for domestic crimes.

"Most of the lynchings that took place happened in the South. A big reason for this was the end of the Civil War. Once black were given their freedom, many people felt that the freed blacks were getting away with too much freedom and felt they needed to be controlled. Mississippi had the highest lynchings from 1882-1968 with 581. Georgia was second with 531, and Texas was third with 493. 79% of lynching happened in the South.

Of the lynching that did not take place in the South, mainly in the West, were normally lynchings of whites, not blacks. Most of the lynching in the West came from the lynching of either murders or cattle thief's. There really was no political link to the lynching of blacks in the South, and whites in the West."

The operative word in "racist joke" is racist not joke. History does matter, I think.

Three guys are caught by a tribe of headhunters in deepest darkest africa:
A black guy
A middle eastern guy
a very white norwegian guy

The headhunters walk up to the black guy and start pinching and poking him all over, oohing and aahing---
the head man says, here is the deal, we are going to boil you alive eat and your heart.  Now, you have a fine ebony skin, very delicate---and your bone structure---
Well, we could use your bones and stretch your skin over them and make a canoe fit for a king, so in honor of this, we will give you one last request....
Give me a knife, the guy says...
Knife????? confused, they go OK
He slits his own throat, saving himself the agony of boiling alive.
They go up to the middle eastern guy and it is the same routine---pinching poking--

the head man says, here is the deal, we are going to boil you alive eat and your heart.  Now, you have a fine bronze skin, very delicate---and your bone structure---
Well, we could bone you and stretch your skin out and make a canoe fit for a prince, so in honor of this, we will give you one last request....
Give me a knife, the guy says...
Knife????? confused, they go OK
He slits his own throat, saving himself the agony of boiling alive.
They go up to the white guy
the head man says, here is the deal, we are going to boil you alive eat and your heart.  Now, you have a good thick skin, big boned --
Well, we could bone you and stretch your skin out and make a good bang around canoe for a hunter or something, so in honor of this, we will give you one last request....
Give me a fork, the guy says...
Fork????? really confused, they go OK
Repeatedly stabbing himself in the chest with the fork,  he cries out, 'FUCK YOU AND YOUR GODDAMN CANOES!!!!'

Yes I found it offensive. From the implication that all black people (and for that matter ONLY black people) wear baggy pants right down to the use of the term negro. But like I said freedom of speech. I'm in full support of your right to say it. To be on the safeside, there are certain neighborhoods I would not advise you to exercise that right in. But hey, Power to the People!

The joke did not imply only black people wore baggy pants ! As for the word negro, the joke is 45 years old. That is what black people were called then. Besides, what is wrong with the word negro/negroid. I am a caucoloid, you can tell me a cauco joke if you wish. These words are not offensive, well not in the uk anyway. Is it so in the USA ?

Jeff Foxworthy, and Jay Leno just to name a few have gotton rich off making fun of white rednecks and trailer trash. You and I both know that not everyone who lives in trailers are trash obviously, but they still get away with it and everyone has a good laugh.

Why should other races be excluded? If you watch family guy, Christianity, Mormonism, and all other groups are prime targets, yet Islam seems to be off limits.

Can you spell H-y-p-o-c-r-i-s-y???

The real problem is that we have politicians now who want to control what we say and how we think. Can you spell O-b-a-m-a???

Look up the first amendment. It doesn't say anything about not offending people. Of course it should be in the proper venue though, that is only common sense.

"I am a caucoloid, you can tell me a cauco joke if you wish."

Don't tempt me like that, because I can do it. In fact if I think of too many I might put a thread up in humor "You might be Whitey if you....". Then you can just say that it takes one to know one.

Actually, I don't think you would defend to the death their right to say it. I don't think anyone would die for free speech. That's why politicians think they can silence Americans under the guise of Hate speech legislation.

I wouldn't die for free speech either. The way I look at it. If people aren't smart enough to vote for politicians who respect the Constitution, then they will get what they deserve.

I didn't know that black people in the UK were wearing baggy pants 45 years ago. (Thanks for the history lesson) If you do not find it offensive that is you. You asked if I found it offensive. I said yes and I also said that I cannot speak for every black person. THIS black person finds it offensive and I could care less what you call yourself or what black people were called before I was born. I FIND IT OFFENSIVE.

That't the problem with those types of jokes. YOU find it funny someone else find it offensive. I don't get to draw the line and neither do you. But we all should be aware that anytime we venture into that territory we are likely to offend SOMEBODY.

And I noticed no one really commented on the 9-11 joke. was it funny or was it offensive....... I suppose that would depend on who you ask. Like I said as a free speech advocate its your right to tell the joke and I would fight for that. PERSONALLY I take offense to it.

There again go the misconceptions. THERE ARE NO LAWS AGAINST TELLING RACISTS JOKES.  So politicians have NOTHING to do with it.  The only control on it, is what people will and won't pay to hear. If the comedian is making money doing it then he does it. If he is not making money telling those type jokes he doesn't do it. BUT NO ONE IS STOPPING ANYONE FROM TELLING WHATEVER TYPES OF JOKES THEY WANT TO TELL.
