Court rules atheism is a religion

Decides 1st Amendment protects prison inmate's right to start study group


A federal court of appeals ruled yesterday Wisconsin prison officials violated an inmate's rights because they did not treat atheism as a religion.


"Atheism is [the inmate's] religion, and the group that he wanted to start was religious in nature even though it expressly rejects a belief in a supreme being," the 7th Circuit Court of Appeals said.

The court decided the inmate's First Amendment rights were violated because the prison refused to allow him to create a study group for atheists.

Brian Fahling, senior trial attorney for the American Family Association Center for Law & Policy, called the court's ruling "a sort of Alice in Wonderland jurisprudence."

"Up is down, and atheism, the antithesis of religion, is religion," said Fahling.

The Supreme Court has said a religion need not be based on a belief in the existence of a supreme being. In the 1961 case of Torcaso v. Watkins, the court described "secular humanism" as a religion.

Fahling said today's ruling was "further evidence of the incoherence of Establishment Clause jurisprudence."

"It is difficult not to be somewhat jaundiced about our courts when they take clauses especially designed to protect religion from the state and turn them on their head by giving protective cover to a belief system, that, by every known definition other than the courts' is not a religion, while simultaneously declaring public expressions of true religious faith to be prohibited," Fahling said.

I disagree with the author of that piece in regard that I have for years claimed that atheism is in fact a set of beliefs hence an antithetical religion that hinges on their "BELIEF" that God does not exist since it is after all a "believe" and not proof.

well religion regardless which way it went was supposed to be protected in this country.


Its also the most abused.  for instance our state constitution says we have the right to "worship" the God of our choice.

In other words pay lip service and as soon as you exercise your beliefs amongst your own you will obey the pubic by-laws OVER your religion.

We now have a problem in that claiming we have the right to our religion and at the same time do not have the ability to practice its tenets is no religion at all.

Here is a candy bar to keep you alive but state law says you cant eat it!

Hmmm, this will be very interesting. 99% of religious groups in prison is a cover for STG activity. Norse religions, and now some Satanic services, are always white supremacists, for example.

We can not take the decision out of the context. I think, within the context the decision has some justification. Otherwise, atheism is not a religion. It is just a philosophical World view some people have.

well atheists "believe" there is no God.  

I dont think it goes any farther than that.

The court is saying that its "belief" versus "belief", hence they are both religions.

No Hun, it's not. God is a religious concept, and the question of the existence or non-existence of a god is a question of religious significance, it is in fact the most fundamental of religious questions.

Atheism is a belief on one particular answer to that question, the lack of a god is a religious stance. It is a belief that negates most religions, but it is still a belief regarding the most basic of religious questions, therefore it is a religious belief.

You, and the other atheists do in fact have religious beliefs in as much as you have beliefs on religious issues and questions.

Here's what I say when confronted with the question "Why do you BELIEVE there is no gawd?"

I question back :
Do you believe in Thor? No.
Do you believe in Ra, The Egyptian Sun God? No, they sheepishly reply since they can see where we're going....
Do you believe in the gods Neptune or Saturn, Pluto, Mars or Mercury ? No.

Well, I simply believe in one less "god" than you do.

The Egyptian religion lasted aout 5,000 years give a hundred years or two.  Christianity has been around for about 2,000 years.  Just sayin' - It seems that NO religion has lasted very long..... on a human scale.

Another, but  non-religious example: People my age truly believed that the Berlin Wall would last forever - at least through our lifetimes.

The substantive definition of religion, is belief.
