Agreed.

But knowing (to the extent we can) Snowden's intentions can, I think, help us determine whether he was truly adhering to our enemies and giving them aid and comfort.

Lee Harvey Oswald was a true believer in his cause. His intentions were just (in his mind) We can say the same for the Oklahoma City bomber and the Unibomber. They were all nutters to their cause. Their cause does not excuse their actions.

But I do think intention may be a factor in determining whether Snowden's actions meet the constitutional criteria for treason.
