I normally don't take the side of police, but a car accident is a car accident,
not a deliberate act.  I wouldn't put someone in jail just for taveling at 112 mile
per hour.  Just because he was driving a 112 miles an hour does not mean he
was driving dangerously.   Germans drive 140 mile per hour on the autobahn.
He may have been speeding, but the real question is why the accident?  Did
he have a high-speed blowout?  Or was he otherwise driving recklessly
weaving in and out around cars?

I find, yet another of your statements flawed, Micheal. For one, they teach a different driving ethic in Germany. One in which the driver understands the responsibility of driving at such a speed. It is also more difficult to attain the driver's license as well. Not only in the terms of money but in the terms of time. I believe it takes somewhere between a year to two years to get ones license.

You also need to take into account that the autobahn was created and is maintained for the speeds which motorist can attain on it. U.S. highways are not. They are maintained for considerably lower speeds.Which then makes it reckless to drive on them for speeds they were not created for.

Also, this person being an authority figure, he should be held accountable as much as (if not more then) any other for breaking the law and speeding. A civilian would've been rushed to the hospital and then rushed to a jail cell for doing this.

What cause the accident is inconsequential. If the officer wasn't speeding then he wouldn't have had the accident.

I think this person should've been hauled to jail. Afterall, that why they have solitary confinment. For those that can not be kept in general population.

Guys-  IMO we will LOSE this one.

the citizens be damned.

Well, that depends on the highways.  Some of those broad and deserted western U.S. highways are actually more appropriate for high-speed driving than German Autobahnen.  But Whip's comment about driving at 140 mph on the Autobahn is pretty misleading, because you can't expect to drive at that speed ANYWHERE and ANYTIME on the Autobahn.  You certainly can't drive 140 mph at night (the usual nighttime speed limit is 130 kmh, or about 80 mph), and about half of the Autobahn system is, sanely, regulated by speed limits that are a lot lower than 140 mph (again, generally in the 70-80 mph range).

Right. There was probably no intentionality in this case which is why the person responsible should be charged with manslaughter:
"MANSLAUGHTER - The unlawful killing of a human being without malice or premeditation, either express or implied; distinguished from murder, which requires malicious intent." http://www.lectlaw.com/def2/m013.htm

But if the cop is simply let off the hook then it would reveal two standards of justice: one for us citizens and one for the police - and, of course, that would be wrong.

What this isn't is a case where there is no clear and obvious remedy for the wrongdoing - the remedy is completely obvious to anyone with a modicum of knowledge and a few brain cells.

i wonder what it feel like to be kissed by a cop.   hmm.  ;-0~

I can see your point about the western U.S. highways.

Well, if they wearn't here illegally they wouldn't have been "kissed."
"CASE DISMISSED!"

i agree... if they would not have been here then it would not have happened and they would be alive today.....

here's a thought.....if a child ran away from home he/ she wouldn't have gotten molested....  you can't blame someone for being HERE....geesh.

MrDiscipline44 -> RE: Off~Duty Vegas Highway Patrolman kiss Illegal Aliens while driving. (9/28/2006 8:35:08 AM)

And if the cop was obeying the law that he is supposed to be enforcing, this wouldn't have happened. Their (the illegals) wrong does not make his wrong, right.

Just because he was driving 112 mph and hit another car DOES mean that he was driving dangerously.  If he had been driving at a reasonable and prudent speed and had a blowout, he MIGHT have been able to keep control of his car and avoid a collision.  Whether he was weaving in and out around cars is irrelevant.  Driving 112 mph on anything but a racetrack is, in and of itself, driving recklessly.  And the fact that he hit another car proves it so.  If the facts of the case are as stated by the OP, he is guilty, at the very least, of negligent homocide.

....ah, but the churchwarden in the next car would have been crushed instead along with three pregnant women and their cats......after all this traffic cop was breaking the law before he hit the other car......the implicit racism from those who suggest that because the victims were illegal immigrants it is somehow not a crime, need to realise that humanity is not an option for human beings, it is a requirement........to forget that is to become monsters.

I don't know, Philosophy - even Frankenstein's monster had a brain. I think some of the people replying here are one brain short of respectable monsterhood.

MstrDouglas -> RE: Off~Duty Vegas Highway Patrolman kiss Illegal Aliens while driving. (9/28/2006 8:48:13 AM)

If the case is still pending, then there are fact that are not known to all of us here.  Speculation is nice, but without all facts of the stiuation, it is just wasted effort.  Over the last few years the insurance companies have added to the confusion as to who is "at fault" in accidents in almost all 50 states.  To cover their profits, and avoid paying off claims they have managed to get it through the courts that both parties are at fault no matter what the actual factors of the accident were.  You are partially at fault the minute you leave your home with your vehicle, wether you are setting still at a stop light, parked in a parking spot, or even running a red light.
However the biggest thing to remember is this, IT IS STILL UNDER INVESTIGATION, charges can still be filed, and until the accident investigation team decides the facts of the accident......well we all just have to wait and see

While I don't often agree with phil, on this subject I must.  The legal status of the people in the other car is immaterial.  Just because people are in this country illegally does not make it okay to kill them.

It's nice to see that racism is still alive ....[:'(] I don't give a damn if they are legal, illegal, blue, green or otherwise...THEY ARE HUMAN BEINGS..with families, children, etc...and that ass should be sitting in jail for killing them with his vehicle...

Hmmm...i don't think this topic is about racism. It said that the people who were killed were illegal aliens. But, where does it say that illegal aliens must be any specific race/color/creed/etc??? The statement above is clearly uneducated and biased toward one race/color of people. Perhaps the Hispanic side of the illegal alien issue? Yes, the majority of illegal aliens are of Hispanic origin, only because it is easiest for them to cross our border illegally and they are the ones who want to actually come here without proper documentation more than any other ethnic group, but that does not mean that we do not have illegal aliens who are of Asian origin, of African origin, of European origin.

Honestly, on the illegal part, we should follow the lead of every other nation in the world: kick them out and not let them back in! Secure our borders, build a wall, post a line of armed guards every 5 yards. i don't care how we do it. Just do it! We don't need illegals coming in when there are plenty of legal residents and citizens who could fill those jobs because they're sitting on the welfare rolls doing nothing but collecting money because their parents did just that.

On the issue at hand: Officers of the law, including police, sheriffs, correctional officers, etc, all have a little note on their DMV reports the police see on their little computers in their patrol cars. It tells the officer who is responding to a situation or who pulls over a car that the person in that car is an officer. It is "professional courtesy" to just ignore traffic violations the person might have made. Is it right? No. If an officer breaks the law, he should be reprimanded for certain, and held accountable for his actions.

Those people in that car should not have been in the United States to begin with. They were in the wrong from the moment they came here and if they had just gone through proper channels, they might still be alive today. If the US had just secured our borders properly, they might still be alive today. This whole situation is tragic in that the people who were the victims have lost their lives unnecessarily. The officer was in the wrong as well. He should not have been driving 112 mph. He should have to face some sort of consequence for his actions.

Just my $.02.

Bright blessings.

.........the charge of racism is based on the fact that the victims were not American.........arguably one could say that racism is the wrong word for this........so suggest another one to describe the attitude of those who seek to excuse the traffic cop on the basis that the victims were non-American and in the country illegally. How about nationalistic-to-the-point-of-inhumanity?

LadyEllen -> RE: Off~Duty Vegas Highway Patrolman kiss Illegal Aliens while driving. (9/28/2006 9:11:14 AM)

Turning this round on its head. What if there was a US student over here in the UK who had outstayed their time..... and I ran them down because I was doing 60mph in a residential street with a 30mph limit.........

Would that be OK too? After all, the student shouldnt have been crossing the road.... 'cause she shouldnt have been here at all.....

Lady E, a compelling argument indeed.

the attitude you see here isnt really directed at those that were killed... moreso with the flood of illegals that permmeates the US.

in 1986, we did an amesty. it was billed as once in a lifetime amnesty.  many of us remember that. which when you consider the attention span of an american, is interesting.

once again- our so called leaders are beholdent to corporate monied interests.

we squalk about this- [but] many of the squalkers would help out a brother in need, when experencing this face to face.

maybe we shouldnt let anymore corporatiions IN TO THE US. and Make the existing ones charter expire just like poeople do, drivers license, passports, etc.

the boogieman is the corporation, not a fellow human being.

Philosophy, there's only three "Races"; Negroid, Mongoloid, Caucasoid.
The article didn't even mention which "race" these people were.
If these people were "Hispanic" as most in here are implying, that's an "ETHNIC group" not a "Race."
Being of "Celtic" heritage I can't go around claiming to be a different "Race"  than Caucaision now, can I?
