Justice.

And I believe that justice can be served by mercy. That is if someone is deserving of a hand up, we should. That if someone really had some seriously mitigating circumstances in the commision of breaking a "law", that he should be spared the maximum penalty, which should be reserved for the arrogant and unrepentive. (I do not mean that in any theological sense)

Mercy is a part of true justice I think. Taking in all the circumstances involved in a harmful act, just what happened ? The problem is to find out, what do you ask ? "Were you afraid when you blew his head off ? ". That happened to a member of my [] family. Life at 18. Imagine that, I am fifty fucking years old. Me and this kid's olman were talking about building him a custom build go cart for his - - 12th birthday ? I don't even remember what year that was. Life imprisonment at eighteen.

So what is justice then ? Seeing the limitations of our subjects and taking them into consideration ? I think that is important. Justice should be served by human beings I think. What else ? A computer that spits out your sentence and your fine based on an algorythm ? Is that what you want ?

No, justice and mercy are two sides of the same apple.

Justice is not justice unless tempered with mercy, and mercy is meaningless without justice. You can't value one without cherishing the other.

As for mercy, show the same amount the person showed their victim(s), which usually is nada.

ABSOLUTELY. I think the death penalty should be applied a hell of alot more than it is. The way it is now is just a fucking show, I mean for real. But that would include politicians. See they are POLY (many) TIC (a parasite). IANS (practicers of a cetain way or ......)

So they get no mercy. The crack addict who commited 75 robberies has a better chance than any politician in my world. At least they didn't abuse the might of the pen.

It is a touchy subject for me. Having had a dear family member murdered, I feel it is unjust that the 2 thugs that beat her to death in her own home are still stealing oxygen from my world.

Justice, to me, would have been feeding them a .357 bullet for their last meal, right after they confessed.......

Justice is much more important than mercy…A society cannot exist without justice but it certainly can without mercy…history has proven it over and over.

Not true. It's like deciding if you want volts or amps. There is a measure, a way that many do not understand. To not be fooled or guided by the path of others but not to embrae it. Just to understand it. Put yourslf in the other fella's shoes in other words. All of them, even those you hate ? ESPECIALLY THOSE YOU HATE.

But to get to the answer here, the lack of mutual exclusivity in no way proves any prevarication or "falseness" on the part of the questioner. This assumption is known as post hoc ergo propter hoc. This is a logistical error, which arises when one thinks that when something proceeds an action, that that action was the cause. One cannot assume this.

Well the only problem with that approach is where it leads. Somebody would want justice for them because they don't care about your suffering and what caused it only what you took from them and what they'll want to take from you. Kind of goes on forever with everyone having their unique sense of justice.

And if they were a really bad asshole, execution would be too good for them. I propose a system whereby the [truly] guilty are not executed, but by choice. They will never ever get out of here. And make it nasty. They will want to be executed. ( my buddy has an even better plan)
 
But then that does nothing for the falsely convicted. That has been discussed and there really isn't shit we can do about it. Not with this system.
