Arizona will go before the U.S. Supreme Court on Wednesday to defend its immigration law, Senate Bill 1070, in a case that will determine the future of immigration enforcement nationwide.

National legal experts predict the high court's ruling will be a landmark decision that determines whether states have the right to enforce federal immigration laws as they see fit.

It is unusual for the Supreme Court to accept a case that hasn't yet been fully adjudicated by the lower courts, but the court appears to want to resolve the issue sooner rather than later. Several other states have passed laws similar to SB 1070, prompting conflicting legal rulings in various appeals-court districts.

"This could be one of the most significant immigration decisions of the last 20 or 30 years," said University of California-Davis School of Law Dean Kevin Johnson. "It raises all kinds of issues that make for great cases: Immigration is an issue of great public importance, it raises issues of state versus federal power and it comes at a time when there is a lot of attention being focused on what's going on on the border."

For Arizonans, SB 1070 is about illegal immigration. For the U.S. Supreme Court, which will hear arguments about the constitutionality of some of its provisions on Wednesday, the issue is federalism -- the respective authority and roles of the federal and state governments.

According to the Brewer administration, Arizona is disproportionately affected by illegal immigration and has a sovereign right to try to address those effects.

The Brewer brief to the Supreme Court acknowledges the singular right of the federal government to determine who can be in the country legally and under what conditions. But it asserts the right of the state to supplement enforcement of federal law so long as state efforts don't directly contravene federal law.

The Obama administration has a radically different view of what states can and cannot do regarding illegal immigration.

According to its brief, Congress has given the executive branch broad discretion regarding the enforcement of federal immigration laws so that a variety of objectives can be balanced and harmonized, including relations with foreign governments.

States can assist with the enforcement of federal immigration laws, but only in cooperation with and under the direction of the federal government.

States cannot unilaterally take actions that conflict with how the executive branch has decided to exercise its discretion regarding enforcing the immigration laws.

Am I understanding this correctly? The Federal government is going to court to affirm its right to NOT do its job?

When bleeding heart Liberals cry about how hard hearted conservatives are for thinking the immigration laws should be followed, how "humane" is it to the honest people waiting to legally enter the country? If we have 18% true unemployment now, what the hell do you think will happen if we allow MILLIONS more of unskilled people in? Oh, and lets vote for the dream act so they can all become citizens thus qualify for WELFARE! So unless you are a Doctor, Pharmacist or some big shot, what you will have left after taxes won't allow you to live too well. I wonder how you bleeding hearts will feel when it becomes necessary to take 50% of your working income to give to the other people who are enjoying welfare, subsidized housing, food stamps, etc. etc.

When it reaches the point where I have to give half of my income to someone sitting on their ass to get theirs, I will join the ass sitters. Any sane person will do the same, thus the income goes down each year. Basic lesson why socialism cannot work.

Actually, I am a bleeding heart liberal, but extremely anti illegal. I have some sympathy for Arizona in trying to protect their own borders, since the fed solution seems to be periodically declaring amnesty. I am not sure why cons think they own this position, particularly when their darling GWB did nothing about illegals himself. Guess when you are a rich boy, you want a source of cheap labor.

The chimp was massively in favour of employing illegals rather than Americans.
I always find this hysterically funny when I look at some of the bullshit the neocon massive spouts about the evils of immigration...

For purely selfish reasons, I hope the SCOTUS slaps Arizona down.

A bass player friend from Taos, New Mexico, a 3rd generation American whose great-grandparents came from Mexico and who became U.S. citizens in 1901, ended up spending a weekend in jail in some one-horse town in Northern Arizona because, while fixing a flat tire, a local Barney Fife stopped, saw that he "looked Mexican" and locked him up because they wouldn't accept his New Mexico driver's license or his Social Security card as proof of his U. S. citizenship. He was taken into custody on a Friday night and was kept locked up until Monday morning when the feds from Immigration/Naturalization got him released.

I've turned down jobs in Arizona since then - and I won't go there unless I can walk the streets there like I do in the other 49 states and not have to "show my papers" to any hick cop who might think I'm not an American (people have often said I look Irish - and there's a lot of illegal Irish in the U. S., particularly in New York City, Chicago and Boston. I wouldn't want some Arizona Dudley Do-Right locking me up as an illegal Irish immigrant).

That is not a selfish reason that is an excellent anecdotal reason the law should be struck down.

its really fucking strange that so many people are saying the feds are soft on immigration when Obama has deported more illegals in the 3ish years he has been Prez than Bush did in his entire 8 years.. I have posted the articles and stats before on some of the illegal immigration threads.. anyone interested can google them..

My guess is that should AZ succeed with this court thingie, then once Obama is re-elected he will bring in new immigration legislation that will allow people to become legal with less hoops to hurdle.. jmo..
